PITTSBURGH — An Allegheny County man is suing Prudential Insurance, alleging breach of contract.
John P. Minnitte filed a complaint Jan. 25 in the U.S. District Court for the Western District of Pennsylvania against Prudential Insurance Company of America, alleging the defendant refused to pay the plaintiff's disability benefits.
According to the complaint, Minnitte worked as a sales or retail counselor until becoming disabled, due to the constant lifting of loads of 50 to 80 pounds. The suit says he submitted his claim for disability benefits that were originally approved until being terminated in 2016.
The plaintiff alleges Prudential notified Minnitte that his disability benefits were being terminated despite having adequate medical proof of his disability.
Minnitte seeks all benefits due, including interest, enjoin the defendant, restitution or surcharge, court costs and all further relief the court grants. He is represented by attorneys Tybe A. Brett and Ruairi McDonnell of Feinstein Doyle Payne & Kravec, LLC in Pittsburgh.
