PHILADELPHIA – Four Montgomery County individuals allege a debt collector unlawfully called them.
Denise Boyd, Robert Dimenna, William Guerra and William Warner filed a complaint on Jan. 25 in the U.S. District Court for the Eastern District of Pennsylvania against Midland Funding LLC and Midland Credit Management Inc. citing the Telephone Consumer Protection Act.
According to the complaint, Midland Funding purchased debts allegedly owned by the plaintiffs and Midland Credit Management was assigned to collect them. The plaintiffs hold Midland Funding LLC and Midland Credit Management Inc. responsible because the defendants allegedly called the plaintiffs using an automatic dialing system and without the plaintiffs' consent.
The plaintiffs request a trial by jury and seek enjoin the defendants from calling the plaintiffs, actual damages or statutory damages of $500 for each call to the plaintiff's cellular telephones, treble damages of $1,000, and any further relief this court grants.
