Phoenixville couple claim 2016 Honda Civic is defective

PHILADELPHIA – A Phoenixville couple have sued Honda, claiming the vehicle they bought last year was defective and violated a number of consumer protection laws in the process.

John Matthew Schweizer and Laura Michelle Schweizer filed suit on Jan. 27 in the Philadelphia County Court of Common Pleas, against American Honda Motor Co. Inc., of Harrisburg.

“On or about April 23, 2016, plaintiffs purchased a new 2016 Honda Civic, manufactured and warranted by defendant [from the Piazza Honda in Pottstown]…the purchase price of the vehicle including registration charges, document fees, sales tax, finance and bank charges but, excluding all other collateral charges not specified yet recoverable under the Lemon Law, totaled more than $25,700.00. Plaintiffs aver that as a result of the ineffective repair attempts made by defendant and its authorized dealer, the vehicle cannot be utilized for the purposes intended by plaintiffs at the time of acquisition and, as such, the vehicle is worthless,” the suit says.

The plaintiffs allege they were issued several written warranties (including a three-year or 36,000-mile warranty) at the time of sale, and believe attorney’s fees and costs will exceed $12,000 if the case proceeds to arbitration and a jury trial. The plaintiffs further allege a number of ineffective repairs were made over the following six months from purchase, to the radio, sound system, navigation information system, electrical system, anti-lock brakes system, and a number of other repairs.

For counts of violating the Pennsylvania Automobile Lemon Law, the Magnusson-Moss Warranty Act, the Unfair Trade Practices and Consumer Protection Law, breach of warranty and revocation of acceptance of contract, the plaintiffs are seeking damages in excess of $50,000, with no submission to arbitration.
