PHILADELPHIA — A Pennsylvania corporation is suing Florida-based defendants Proterra Solutions LLC, Stanley Gibson, Deborah Gibson and Mark Lafon, alleging breach of contract, breach of warranty and fraud.
Agri-Marketing Inc. d/b/a USA Gypsum filed a complaint on Feb. 10 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to deliver goods to the plaintiff based on their contractual agreement.
According to the complaint, the plaintiff alleges that it sustained financial damages to its business. The plaintiff holds the defendants responsible because they allegedly failed to deliver a complete recycling system to the plaintiff as agreed upon in a contract.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds $75,000 plus interest, court costs and any further relief this court grants. The plaintiff is represented by Melvin H. Hess and Jonna E. Stratton of Gibbel Kraybill & Hess LLP in Lancaster.
