SCRANTON – A leading insurance provider is pursuing litigation against a manufacturing firm for damages incurred from the alleged malfunction of a hot water heater.
Allstate Insurance Company of Malvern (on behalf of Vongchanh Sanaphol, of Scranton) filed suit on Feb. 8 in the Lackawanna County Court of Common Pleas, versus Rheem Manufacturing Company of Atlanta.
“The plaintiff’s insured bought a Rudd brand hot water heater manufactured by the defendant, which plaintiff believes was manufactured in 2013. The water heater was a natural gas-fueled automatic storage water heater with a capacity of 50 gallons. On or about Oct. 18, 2016, the hot water heater leaked, causing the damages set forth more fully hereinafter,” the lawsuit says.
The plaintiff says the defendant’s negligence, defective design in manufacturing the hot water heater and failure to warn customers of the hazards associated with the device are directly responsible for the damages the water heater caused. As a result, the plaintiff paid Sanaphol the sum of $17,223.28
For counts of negligence, defective design and manufacture and breach of implied warranties, the plaintiff is seeking damages of $17,223.28 together with interest from Oct. 18, 2016, plus costs.
The plaintiff is represented by Paul N. Sandler of Sandler & Marchesini, in Philadelphia.
