Plaintiff says fatal pressure ulcers allowed to develop and deteriorate, causing patient's death

MEDIA – A litigant claims that a number of defendants were negligent in their medical care and directly responsible for causing a woman’s death due to development and deterioration of pressure ulcers.

Horace Davis of Chester (Administrator of the Estate of decedent Grace Kelly Davis) filed suit on Feb. 17 in the Delaware County Court of Common Pleas, versus 2507 Chestnut Street Operations, LLC, Genesis Healthcare, LLC and Crozer-Chester Medical Center, all of Chester, Delaware County Memorial Hospital of Drexel Hill, Crozer-Keystone Health System of Springfield, Kindred Hospital East, LLC and Kindred Hospital Philadelphia – Havertown, both of Havertown, Kindred Healthcare, Inc. of Louisville, Ky., Mercy Catholic Medical Center of Southeastern Pennsylvania of Darby and Mercy Health System of Southeastern Pennsylvania, in Conshohocken.

According to the lawsuit, Kelly Davis developed pressure ulcers, including a Stage IV sacral pressure ulcer, as a result of her care received at The Belvedere Center, Crozer-Chester Medical Center, Delaware County Memorial Hospital Kindred Hospital Philadelphia – Havertown and Mercy Catholic Medical Center.

Due to the pressure ulcers, Kelly Davis ultimately passed away on Nov. 20, 2015. The plaintiff says the defendants failed to administer and utilize proper care of Kelly Davis over the course of her stay in residential care and various hospital admissions from March 2015 to August 2015, leading her wounds to “persist and deteriorate.”

“As a direct and proximate result of the aforementioned conduct, plaintiff’s decedent sustained serious injuries, including but not limited to, the development and/or deterioration of multiple pressure ulcers, including a stage IV sacral pressure ulcer, and death,” the suit says.

For counts of negligence, corporate negligence, and violating the Survival Act and Wrongful Death Act, the plaintiff is seeking damages in excess of $50,000.

The plaintiff is represented by Christopher J. Culleton of Swartz Culleton, in Newtown.
