PHILADELPHIA – A woman’s lawsuit filed against a Center City Philadelphia shoe store she purchased a pair of sandals from, which she was allegedly injured by, has been dismissed from state court for failure to state a claim.
Michele Brown of Philadelphia filed suit on Feb. 15 in the Philadelphia County Court of Common Pleas, against Eternity Shoes, also of Philadelphia.
“I went into the Eternity Shoes store wanting a pair of sandals, so I looked and looked and came across these gold crisscross sandals on sale for $10.00. I wore them on Memorial Day [2016] and also after, and those shoes cut up the inner parts of my feet. I ran to the hospital and blood was coming out of my inner feet when I arrived at the hospital,” the lawsuit said.
Brown added she consulted a physician and received an MRI of her foot, providing those records in her complaint and to the sandals’ manufacturing company, and added the defendant is responsible for her burned and blistered left and right feet.
However, on Feb. 17, Judge Idee C. Fox dismissed the case for failure to state a claim. The plaintiff represented herself in this matter.
