Health care worker says she suffered assault and battery at hands of former employer

PHILADELPHIA – A Philadelphia woman has sued her former employer for damages, after allegedly being on the receiving end of assault and battery from the co-owner of the home healthcare business.

Maria Capellan filed suit on Feb. 14 in the Philadelphia County Court of Common Pleas, against Queenth Madu of Upper Darby and Rite Choice Family Services, Inc. of Philadelphia.

“On Oct. 6, 2016, plaintiff was working at her job at defendant Rite Choice when confronted by defendant [Queenth] Madu, who intended to cause harmful or offensive contact with the plaintiff. Defendant Madu placed the plaintiff in imminent danger of contact,” the lawsuit says.

“Defendant Madu did engage in offensive upon the plaintiff by striking plaintiff repeatedly, wherefore committing a battery. As a result of the assault and battery committed by defendant Madu upon plaintiff, plaintiff suffered both physical injuries, as well as emotional injuries, including shock, fright and humiliation,” the lawsuit adds.

For counts of assault and battery, the plaintiff is seeking all damages under the laws of the Commonwealth of Pennsylvania, actual damages, physical and emotional damages, plus punitive damages of an unspecified amount.

The plaintiff is represented by Howard K. Trubman of the Employment Law Firm of Pennsylvania, in Philadelphia.
