PITTSBURGH — A Pittsburgh construction company is suing H.D. Forming Co. Inc. and Dayton Superior Corporation, citing alleged liability for bad specifications and engineering work on a parking garage.
Mosites Construction Company filed a complaint on Dec. 15 in the Court of Common Pleas of Allegheny County against the defendants alleging that hangers acting as a framework for the concrete structure failed because of faulty work. H.D. Forming provided specifications in July through August of 2014 for the work, and Dayton Superior provided the metal structures based on those plans. A top level of the garage, built for The Gardens at Market Square on Forbes Avenue in Pittsburgh, collapsed during construction.
According to the complaint, the plaintiff alleges that it sustained damages to its company when the hangers that supported their concrete formwork failed. Mosites holds the defendants responsible because they allegedly failed to make sure that the hangers they sold to the plaintiff were free of any defects and were properly welded.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds the jurisdiction of this court. The plaintiff is represented by William R. Miller.
