Shipley Enterprises failed to pay overtime, former employee claims

PHILADELPHIA — A warehouse worker and delivery driver is suing Shipley Enterprises Inc., Eugene Shipley and Tammara Shipley of Cheltenham, citing alleged breach of contract, unpaid wages and violation of workers compensation acts.

Raymond Burg Jr. filed a complaint on Feb. 28 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they failed to pay adequate wages to the plaintiff based on his total working hours.

According to the complaint, Burg alleges that he sustained damages from not being paid any overtime wages despite working at least 51 weeks of over 40 hours per week. The plaintiff holds the defendants responsible because they allegedly classified the plaintiff as an independent contractor in order to avoid paying overtime wages.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $4,909.06 plus interest and court costs. He is represented by Elliot B. Platt of Philadelphia.
