PHILADELPHIA – A decedent’s estate has filed a lawsuit against the manufacturer and distributor of a Kenmore-brand gas grill it says malfunctioned and caused an extremely-damaging fire at that same decedent’s property.
The Estate of Edith Sleighter of Chambersburg filed suit on Feb. 23 in the Philadelphia County Court of Common Pleas, versus Electrolux Home Ranges, Inc. of Charlotte, N.C. and Sears Roebuck And Co., of Hoffman Estates, Ill.
“The plaintiff purchased the subject gas range from Sears on or about Aug. 30, 2013. On or about Dec. 26, 2015, a fire erupted at the subject property causing extensive damage to the plaintiff’s real and personal property, as well as the imposition of additional expenses and hardship besides, which was directly and proximately caused by the defendants. The fire was caused by the malfunction of the range which was manufactured by Electrolux and sold, distributed, marketed, assembled, delivered, and/or serviced and repaired by Sears,” the suit says.
For counts of negligence, breach of warranties and strict liability against each defendant, the plaintiff is seeking damages, individually, jointly and severally, in excess of $50,000, plus attorney’s fees, costs, delay damages and other relief, in this matter.
The plaintiff is represented by Joseph L. McGlynn and Raymond E. Mack of deLuca Levine, in Blue Bell.
