LANCASTER – A Pennsylvania woman believes the resident school district’s lack of maintenance of their sidewalk caused her to fall and become seriously injured.
Lashaun Pearson of Manheim filed suit on Feb. 16 in the Lancaster County Court of Common Pleas, against The School District of Lancaster, based in that same city.
“On Feb. 27, 2015, the plaintiff was proceeding on the sidewalk of the school district toward her bus stop for transportation to her employment and while proceeding on said sidewalk was caused, by the deplorable and slippery condition of the sidewalk, to slip and fall, sustaining personal injuries,” the suit says.
“The plaintiff avers that the aforesaid occurred and was entirely due to the negligence of the defendant, in that it permitted said sidewalk to deteriorate to a condition less than the required standards existing under the Code for the City of Lancaster as well as not being adequately maintained safely, as the walkway was slippery and untreated to a degree that hills and ridges had developed and a safe means of travel was not made available to the plaintiff,” the suit adds.
Pearson says the school district was aware of the condition of the sidewalk before her accident, yet failed to repair it. Pearson adds as a result of the fall, she suffered a severely broken right ankle, plus a considerable time of feeling ill and sore.
The plaintiff is seeking damages in excess of $75,000 in this matter.
