Labor Department sues Philly restaurant on behalf of employees seeking unpaid wages

PHILADELPHIA — The United States Labor Department is suing Tierra Colombiana Inc. d/b/a Tierra Colombiana; Mixto Inc. d/b/a Mixto; and Jorge and Mercy Mosquera, restaurant operators, citing alleged breach of contract, unpaid wages and violation of Workers' Compensation acts.

Edward C. Hugler, acting Secretary of Labor, filed a complaint on March 3 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they failed to pay proper wages to their employees.

According to the complaint, Hugler alleges on behalf of the affected employees that they were not properly compensated for their work. Hugler claims the defendants are responsible because they allegedly failed to pay overtime and minimum wages to their employees.

The plaintiff seeks to enjoin the defendant and seeks unpaid minimum wages, overtime compensation, liquidated damages, court costs and any further relief the court grants. M. del Pilar Castillo and Jennifer Bluer of the Office of the Solicitor, Region III in Philadelphia are the representative attorneys.
