Railway worker says Conrail failed to provide timely medical attention, retaliated for complaint

PHILADELPHIA — An railway worker is suing Consolidated Rail Corporation (Conrail), a company headquartered in Philadelphia, citing alleged insufficient measures were taken to prevent injuries, liability, negligence and retaliation.

Robert D. Jones, who worked for the defendant in its Newark, New Jersey, location, filed a complaint on March 15 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendant accused plaintiff of falsely reporting an injury that happened to him while performing his duties at work and failed to provide timely medical attention.

According to the complaint, the plaintiff alleges that he sustained a laceration of his left hand and finger when a brake chain suddenly moved on a handcar he was inspecting, trapping his left hand in the process. The plaintiff holds Conrail responsible because it allegedly refused to provide immediate medical treatment to the plaintiff by taking him to the emergency room, instead asking the other supervisors to take them to the accident scene.

The plaintiff requests a trial by jury and seeks compensatory damages, statutory damages, punitive damages, special damages and court costs. He is represented by Robert E. Myers and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
