PITTSBURGH - A Pennsylvania bus equipment and repair company is suing P. Ferguson Transportation Inc., citing alleged breach of contract for failure to pay for equipment it has received from the plaintiff.
Myers Equipment Corporation filed a complaint March 23 in the U.S. District Court for the Western District of Pennsylvania alleging the Ohio corporation failed to pay the plaintiff for bus equipment.
According to the complaint, the plaintiff alleges Myers Equipment sustained financial damages to its company. The plaintiff holds Ferguson responsible because it allegedly breached its contractual agreement with the plaintiff by failing to make necessary payments to the plaintiff when due. Since Ferguson's payments are in default, Myers claims it now should possess the bus equipment.
The plaintiff seeks immediate possession of the bus equipment, special damages, interest, court costs and any further relief the court grants.
