Carpenters union claims Nuway failed to make contributions to fund per contract

PITTSBURGH - A labor group is suing Nuway Scaffolding LLC, a construction contractor, citing alleged breach of contract for failing to make union payments.

Carpenters Combined Funds Inc., through James R. Klein, filed a complaint March 21 in the U.S. District Court for the Western District of Pennsylvania against the Altoona business alleging it failed to pay fringe benefit contributions to the labor group.

According to the complaint, Carpenters alleges it sustained damages, on behalf of affected employees, due to the unpaid contributions. The plaintiff holds Nuway responsible because it allegedly failed to honor its contractual agreement with the union to contribute said funds.

The labor group seeks permanent injunction enjoining the defendant, immediate payment of all monies past due, complete and accurate remittance reports, a sum of $88,834.52 plus contractual and liquidated damages, court costs of 20 percent of the total amount and any further relief the court grants.

The union is represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg PC in Pittsburgh.
