PHILADELPHIA — Per court records, a settlement has been reached in the case of a woman who sued a Kansas-based movie theater chain for injuries.
U.S. Magistrate Judge Carol Sandra Moore Wells issued an order on March 1 stating the action in question was dismissed with prejudice, pursuant to agreement of counsel without costs.
Amanda L. Brady initially filed a lawsuit against American Multi-Cinema Inc., doing business as AMC Woodhaven 10 and AMC Entertainment Inc., in the Philadelphia County Court of Common Pleas on June 16, 2015, claiming she sustained injuries on the defendant’s premises.
Brady claimed she tripped and fell in the AMC Woodhaven 10 Theater in Bensalem, on or about July 16, 2013.
Brady’s counsel wrote a letter to the defendant’s claims adjuster on or about May 12, 2015, demanding payment in the amount of $378,000 and alleging serious and painful injuries including “cuboid fracture, talus contusion and development of reflex sympathetic dystrophy, a/k/a complex regional pain disorder (CRPD) to the right foot; and damage to her bones, cells, muscles, tissues and her nervous system.”
Two weeks after its filing, records indicate the case was removed by the defendants from the Philadelphia County Court of Common Pleas to the U.S. District Court for the Eastern District of Pennsylvania.
Court records state an undisclosed arbitration amount was awarded to the plaintiff on Dec. 20, 2016, to which the defendants objected and insisted on a de novo trial or possible reference to a U.S. Magistrate Judge. Wells then received the case on Jan. 31, and subsequently, a final settlement agreement was reached, terms of which were not disclosed.
The plaintiff was represented by Edward J. Zanine of Flager & Associates in Trevose.
The defendants were represented by Ralph J. Luongo and Francis X. Simpson of Carroll McNulty & Kull, plus Anneliese Scott of General Dynamics Information Technology, all in Philadelphia.
