Couple sue BOA, Nationstar, alleging they refused to honor mortgage modification agreement

PHILADELPHIA — An Oxford couple are suing Bank of America N.A., Nationstar Mortgage LLC and the Bank of New York Mellon, citing alleged misrepresentation in debt collection.

Glenn E. Nask and Michelle Nask filed a complaint on March 29 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendants used unfair, abusive and deceptive means in attempting to collect a debt from the plaintiffs.

According to the complaint, the plaintiffs allege that they sustained damages because Nationstar refused to honor a mortgage rate modification that was made before it was transferred from Bank of America. The plaintiffs hold the defendants responsible because they allegedly made false representations as to the total amount of the plaintiff's debt.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds $50,000. They are represented by Joseph F. Claffy of West Chester.
