Woman says Unum Life Insurance wrongly cut off disability benefits

PHILADELPHIA — An individual is suing Unum Life Insurance Company of America, citing alleged breach of contract for what she says was wrongful termination of her disability benefits.

Melissa Maiellano filed a complaint on April 3 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the insurance company refused to pay benefits entitled to the plaintiff.

According to the complaint, the plaintiff alleges that, in 2013, she left her employment due to her disability and was approved to receive disability benefits, but they were later wrongly terminated. The plaintiff holds the defendant responsible because it allegedly terminated plaintiff's benefits alleging that her conditions were due to behavioral rather than physiological issues, which the plaintiff disputes.

The plaintiff seeks judgment against the defendant in the amount of 60 percent of the plaintiff's gross monthly salary, interest, court costs and any further relief this court grants. She is represented by Jamie R. Hall of the Law Office of Jamie R. Hall in Kennett Square.
