Home health workers say All American in Philadelphia failed to pay overtime

PHILADELPHIA — Two employees have filed a class action lawsuit against All American Home Care LLC, citing alleged unpaid wages, violation of applicable minimum wage law and violation of Workers' Compensation acts.

Jerry Acosta Jr. and Modestine Smith Thorpe filed a complaint on behalf of all persons similarly situated on April 11 in the U.S. District Court for the Eastern District of Pennsylvania against the home care company alleging that it failed to fully compensate the plaintiffs for their work.

According to the complaint, the plaintiffs allege that they sustained damages from not being paid minimum and overtime wages. The plaintiffs hold the defendant responsible because it allegedly disregarded Pennsylvania law by refusing to pay the plaintiffs for their work at the appropriate rate.

The plaintiffs request a trial by jury and seek back pay damages, unpaid overtime compensation, interest, liquidated damages, court costs and any further relief this court grants. They are represented by Richard M. Simins and Jackson E. Warren of Montgomery McCracken Walker & Rhoads LLP in Philadelphia.
