Doctor claims Optum Inc. sent unwanted faxes to advertising business

PHILADELPHIA — A Center Valley doctor has filed a class action lawsuit against Optum Inc. and Optuminsight Inc., a Minnesota medical services company, citing alleged violation of telephone harassment statutes.

Robert W. Mauthe M.D. filed a complaint on behalf of all others similarly situated on April 11 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendant sent unsolicited fax advertisements to the plaintiff.

According to the complaint, the plaintiff alleges that he sustained damages from receiving the unsolicited fax advertisements. The plaintiff holds the defendant responsible because it allegedly sent advertisements through facsimile machines to advertise its business and services.

The plaintiff seeks damages, punitive damages, court costs and any further relief this court grants. He is represented by Richard Shenkan of Shenkan Injury Lawyers LLC in New Castle.
