PITTSBURGH — An Illinois food-packaging corporation is suing Kraft Heinz Foods Company and The Kraft Heinz Company, citing breach of contract for allegedly distributing trade secrets to its competition.
Aptargroup Inc. filed a complaint on April 21 in the U.S. District Court for the Western District of Pennsylvania against the defendants alleging that they misappropriated plaintiff's confidential information.
According to the complaint, the plaintiff alleges that it sustained damages to its company from having its contract breached and its confidential information wrongfully used. The plaintiff holds Kraft Heinz responsible because it allegedly distributed plaintiff's confidential information to its competitors. Kraft Heinz is a longtime customer of the plaintiff, which deals in food packaging and specifically food dispensing technologies for Kraft Heinz products like ketchup.
The plaintiff seeks injunction against the defendant, the cessation of all unauthorized disclosure of any of plaintiff's confidential information, compensatory, punitive and exemplary damages, court costs, restitution, interest and any further relief this court grants. They are represented by Scott D. Livingston and Jonathan D. Marcus of Marcus & Shapaira LLP in Pittsburgh and Stephen A. Swedlow, Nathan Hamstra and Michelle Schmit of Quinn Emanuel Urquhart & Sullivan LLP in Chicago.
