Woman holds Bayer, Merck responsible for negative side effects of Avelox

PHILADELPHIA — A Hawaii woman is suing Bayer Healthcare Pharmaceuticals Inc.; Bayer Corporation; Bayer AG; Bayer Pharma AG; and Merck & Co. Inc., citing alleged breach of warranty, fraud, liability, negligence and negligent misrepresentation.

Linda Rodriguez filed a complaint on April 27 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that she experienced negative side effects from their drug Avelox.

According to the complaint, the plaintiff alleges that she suffered injuries from taking the drug including weakness and loss of balance. The plaintiff holds the defendants responsible because they allegedly failed to inform consumers including plaintiff of the potential negative effects of taking Avelox.

The plaintiff requests a trial by jury and seeks damages that exceed the minimum jurisdictional limits of this court, medical expenses, interest, compensatory damages, consequential damages, punitive damages, court costs and any further relief this court grants.
