C&S Wholesale says former employee breached employment contract

Contract 05

PHILADELPHIA — A New Hampshire grocery wholesaler and its subsidiary are suing Matthew Saunders, a former executive with the companies, citing alleged breach of contract.

C&S Wholesale Grocers Inc. and Robesonia Logistics LLC filed a complaint on April 27 in the U.S. District Court for the Eastern District of Pennsylvania against Saunders alleging that he failed to inform the plaintiffs of claims and litigation against them.

According to the complaint, the plaintiffs allege that they sustained damages to their companies from Saunders' actions. The plaintiffs hold Saunders responsible because he allegedly breached his contractual agreement with the plaintiffs by disclosing confidential information when he was hired as an expert witness by a company that filed a demand for arbitration with the plaintiffs.

The plaintiffs seek injunction against the defendant, compensatory damages not less than $75,000 and any further relief this court grants. They are represented by Michael J. Fortunato and Karen P. Gaster of Rubin, Fortunato & Harbison P.C. in Paoli.
