PHILADELPHIA — A physician in Center Valley has filed a class-action lawsuit against Gaither Technologies STC LLC and Mingle Analytics Inc., of Indiana and Maine, respectively, alleging violation of telephone harassment statutes.
Robert W. Mauthe filed a complaint on behalf of a class of similarly situated persons on May 10 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they sent unsolicited facsimile messages to the plaintiff.
According to the complaint, the plaintiff alleges that he was damaged from receiving unsolicited advertisement fax messages. The plaintiff holds Gaither Technologies and Mingle Analytics responsible because the defendants allegedly sent advertisement messages to the plaintiff without his consent, wasting his time and materials and occupying his fax machine's use..
The plaintiff seeks appropriate damages, punitive damages, court costs and any further relief this court grants. He is represented by Richard Shenkan of Shenkan Injury Lawyers LLC in New Castle.
