Two railway employees say NJ Transit Rail retaliated for whistleblowing

PHILADELPHIA — Two railway employees are suing NJ Transit Rail Operations Inc., alleging discrimination, liability and violation of federal law.

Jermaine Jenkins and Jerome Johnson filed a complaint on May 16 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the employer engaged in retaliatory behavior against them after they challenged unlawful and unsafe work practices that their supervisors instructed them to participate in. Both men had previously filed suit against the company individually and now sue the defendant as joint plaintiffs.

According to the complaint, the plaintiffs allege that they were damaged from not being treated equally by their employer. The plaintiffs hold NJ Transit Rail Operations responsible because it allegedly threatened and retaliated against the plaintiffs for raising concerns.

The plaintiffs request a trial by jury and seek compensatory damages, punitive damages, special damages and court costs. They are represented by Robert E. Myers and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
