PITTSBURGH — A New Jersey insurance company is suing Aveda Transportation and Energy Services Inc., 77 Energy Inc. and Hodges Trucking Company LLC, alleging breach of contract for damaging equipment they were transporting.
Arch Specialty Insurance Company, on behalf of subrogee B & K Equipment LLC, of Wyalusing, filed a complaint on May 19 in U.S. District Court for the Western District of Pennsylvania against the defendants alleging that they caused damage to a generator owned by the plaintiff.
According to the complaint, the plaintiff alleges that, on Jan. 13, 2015, its business was financially damaged when its generator was damaged. The plaintiff holds the defendants responsible because they allegedly failed to safely move the generator for the plaintiff's insured.
The plaintiff requests a trial by jury and seeks judgment against the defendants and any further relief this court grants. It is represented by Jeffrey C. Sotland and Ryan Mick of Mintzer Sarowitz Zeris Ledva & Meyers LLP in Pittsburgh.
