PHILADELPHIA — A Bridgeville company is suing Oerlikon Metco (US) Inc. and James H. Ryan, alleging breach of contract for misuse of trade information.
Carpenter Technology Corporation filed a complaint on May 25 in U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they misappropriated plaintiff's trade secrets.
According to the complaint, the plaintiff alleges that Carpenter Technology Corporation was damaged from having its trade secrets disclosed to competitor Oerlikon, for whom Ryan now works after resigning from Carpenter in April. The plaintiff holds the defendants responsible because Ryan allegedly copied plaintiff's trade secrets, customer lists and other confidential information from his work computer to flash drives before resigning and taking a job with Carpenter's competitor, in violation of the intellectual property clause of his employment agreement.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds $75,000 plus interest and court costs. It is represented by Daniel P. O'Meara and Amanda D. Crawford of Montgomery, McCracken, Walker & Rhoads LLP in Philadelphia.
