Norristown man says Merrick Bank used auto-dialer regarding alleged debt

PHILADELPHIA — An individual is suing Merrick Bank Corp., a Utah corporation, alleging violation of telephone harassment statutes.

Danon J. Doyle of Norristown filed a complaint on May 30 in U.S. District Court for the Eastern District of Pennsylvania alleging that the financial institution called the plaintiff several times in an attempt to collect an alleged debt owed by his mother.

According to the complaint, the plaintiff claims that he was damaged from receiving several unwanted collection calls. The plaintiff holds Merrick Bank Corp. responsible because it allegedly utilized an automatic telephone dialing system to call the plaintiff.

The plaintiff requests a trial by jury and seeks $500 for each negligent violation, $1,500 for each knowing violation, injunctive relief, statutory damages of $1,000, actual damages, punitive damages, court costs, interest and any further relief this court grants. The plaintiff is representing himself in the case.
