Pension Benefit Guaranty sues Fay Construction over terminated pension plan

PHILADELPHIA — A government corporation dealing with terminated pension plans is suing Fay Construction Co. Inc., as plan administrator for the Fay Construction Co. Inc. pension plan, alleging breach of contract.

The Pension Benefit Guaranty Corporation, a government entity located in Washington, D.C., filed a complaint on June 16 in U.S. District Court for the Eastern District of Pennsylvania alleging that the Media-based contractor failed to provide pension benefits to its employees.

According to the complaint, the plaintiff alleges that the pensioners it represents were damaged from not being paid benefits. The plaintiff holds Fay Construction responsible because the defendant allegedly failed to make payments to eligible participants.

The plaintiff seeks benefits owed and any further relief this court grants. Israel Goldowitz, Kartar Khalsa and C. Wayne Owen are the representatives from the organization.
