Suit alleges former technician with Wizzard Drain Cleaning was denied overtime

SCRANTON — A former employee is suing Brian Murlin, Becky Murlin & Wizzard Drain Cleaning LLC, citing alleged unpaid wages and violation of Workers' Compensation acts.

Shane Huyett filed a complaint on June 19 in U.S. District Court for the Middle District of Pennsylvania against the defendants alleging that they failed to pay proper wages to the plaintiff equal to the total number of hours worked.

According to the complaint, the plaintiff, who worked for defendants as a drain cleaner technician, alleges that he was damaged from working more than 40 hours weekly without being paid overtime wages. The plaintiff holds the defendants responsible because they allegedly retaliated against the plaintiff for complaining about not being paid overtime wages.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, liquidated damages, interest, court costs and any further relief this court grants. He is represented by Steve T. Mahan, Derrek W. Cummings and Larry A. Weisberg of McCarthy Weisberg Cummings P.C. in Harrisburg.
