PHILADELPHIA – A Texas man has filed suit against Pennsylvania-based telecommunication service provider alleging that it failed to pay overtime to its field technicians.
Tommy Pham filed a complaint on behalf of himself and all others similarly situated on June 27 in the U.S. District Court for the Eastern District of Pennsylvania against Quadgen Wireless Solutions Inc. alleging violation of the Fair Labor Standards Act and the North Carolina Wage and Hour Act.
According to the complaint, the plaintiff worked for the defendant as a field technician from May to October 2016. The plaintiff holds Quadgen Wireless Solutions Inc. responsible because the defendant allegedly allowed the plaintiff to work for more than 40 hours per week without paying him overtime wages.
The plaintiff requests a trial by jury and seeks actual and statutory damages, unpaid overtime wages, liquidated damages, court costs and any further relief the court grants. He is represented by Justin L. Swidler of Swartz Swidler LLC in Cherry Hill, New Jersey.
