FXI Inc. alleges former employee breached agreement by working for competitor

PHILADELPHIA – A Media company alleges a former employee residing in Massachusetts violated a noncompetition agreement.

FXI Inc. filed a complaint on July 31 in the U.S. District Court for the Eastern District of Pennsylvania against Christopher Lorenz alleging breach of competition agreement and misappropriation of trade secrets.

According to the complaint, the defendant is a former employee of the plaintiff and left to work for direct competitor Woodbridge FoamPartner. The plaintiff alleges that the defendant working for the competitor is a violation of his agreement not to compete with the plaintiff. It claims that "it is inconceivable that defendant could and will perform his job without relying upon and using FXI’s goodwill, trade secrets and confidential information regarding FXI’s customers and products," the complaint states.

The plaintiff requests a trial by jury and seeks enjoin the defendant, order the defendant to return all documents and information to the plaintiff, actual damages, compensatory damages, punitive damages, interest, court costs and any further relief the court grants. It is represented by Richard G. Rosenblatt and Justin K. Victor of Morgan, Lewis & Bockius LLP in Philadelphia.
