PHILADELPHIA – Several companies engaged in the nonemergency medical and school transport and a uniform maker are alleged to have failed to pay employees a minimum wage.
Secretary of Labor of the United States Department of Labor R. Alexander Acosta filed a complaint on Aug. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Advanced Life Support Ambulance Inc., Art of Life Inc., Ez Trans Enterprise Inc., Regional Medical Transportation Inc., Drive Thru Graphics LLC and Nikanor Broytman citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that the defendants unlawfully required employees to pay for uniforms, moving violations and insurance deductibles. Because of this, the plaintiff alleges the defendants' employees were not paid a minimum wage for all hours worked. The defendants also allegedly failed to pay for overtime work at a rate of time-and-one-half of their regular wage rate.
The plaintiff seeks injunction against the defendants, to find the defendants liable for unpaid minimum and overtime compensation, liquidated damages, court costs, interest and any other relief as the court deems just. He is represented by Oscar L. Hampton III of Office of the Solicitor in Philadelphia.
