PHILADELPHIA – A Pittsburgh health care service provider is alleged to have failed to pay the correct rate for overtime.
Mark White filed a complaint on behalf of all others similarly situated on Aug. 10 in the U.S. District Court for the Western District of Pennsylvania against 1 Person At a Time LLC alleging violation of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.
According to the complaint, the plaintiff began employment with the defendant in September 2016 but has not been assigned any clients since July 20. He alleges that prior to March, he was not paid at a rate of time-and-one-half for overtime work.
The plaintiff holds 1 Person At a Time LLC responsible because the defendant allegedly failed to pay him for work from July 15 to July 20, failed to keep complete time records and failed to pay him full overtime wages that he is entitled.
The plaintiff requests a trial by jury and seeks unpaid overtime wages, restitution, liquidated damages, court costs, and any further relief the court grants. He is represented by Gary F. Lynch, Jamisen Etzel and Kevin Abramowicz of Carlson Lynch Sweet Kilpela and Carpenter LLP in Pittsburgh.
