Sungard Availability Services LP alleged to have failed to pay overtime

PHILADELPHIA – A Maryland man alleges his former Wayne IT service employer terminated him after he complained about discrimination and not receiving overtime pay.

Michael Carter filed a complaint on Aug. 14 in the U.S. District Court for the Eastern District of Pennsylvania against Sungard Availability Services LP alleging violation of the Fair Labor Standards Act and other counts.

According to the complaint, the plaintiff alleges that the defendant misclassified him as a salaried employee in order to avoid failing to pay him overtime. He also alleges that he was terminated on Jan. 27, 2016, in retaliation about a previous race discrimination claim he made on Jan. 8.

The plaintiff seeks compensatory damages, back pay, front pay, lost benefits, court costs and any further relief the court grants. He is represented by Scott M. Pollins of Pollins Law in Swarthmore.
