Motorists Mutual Insurance Co. seeks damages after property fire

ERIE – An insurance company is seeking damages after a fire allegedly caused by the negligent installation of insulation in an attic.

Motorists Mutual Insurance Co., as subrogee of Mary Matz, filed a complaint on Aug. 25 in the U.S. District Court for the Western District of Pennsylvania against CLEAResult Consulting Inc. and Comfort Home Corp., doing business as EIC/Comfort Home alleging negligence and other counts.

According to the complaint, Matz's Coal Center property was insured by Motorists Mutual. The suit states that the CLEARresult Consulting performed an energy assessment of the Matz property and as a result, Comfort Home Corp. installed blown-in insulation in the attic. The suit states Comfort Home Corp. failed to install an insulation shield around a fireplace flue pipe and on Oct. 4, 2015, a fire occurred in the attic after Matz lighted a fire. 

Motorists Mutual Insurance Co. alleges it paid the fair and reasonable value of the property damage.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount of more than $75,000 plus interest, court costs and any further relief the court grants. They are represented by R. Douglass Klaber Jr. of Robb Leonard Mulvihill LLP in Pittsburgh.
