Dart Container Corp. of Pennsylvania alleged to have terminated man for taking FMLA leave

EASTON – A Lancaster County man alleges his former foodservice packaging solutions employer interfered with his right to take a medical leave.

William Turner filed a complaint on Sept. 5 in the U.S. District Court for the Eastern District of Pennsylvania against Dart Container Corp. of Pennsylvania alleging violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff began his employment with the defendant in September 2014 and was terminated in March. He alleges beginning in August 2016, he was approved for FMLA leave to care for his ill wife and that he faced a hostile attitude from his supervisors because of it.

The plaintiff holds Dart Container Corp. of Pennsylvania responsible because the defendant allegedly terminated plaintiff's employment in response to him taking intermittent FMLA leave.

The plaintiff seeks judgment against the defendant, back pay and benefits, reinstatement, front pay, liquidated damages, court costs and any further relief the court grants. He is represented by Larry A. Weisberg, Derrek W. Cummings and Stephen T. Mahan Jr. of McCarthy Weisberg Cummings PC in Harrisburg.
