Travelers Casualty and Surety Co. of America alleges Pellman Electric failed to reimburse it

Contract 06

PITTSBURGH – An insurance company alleges it is owed reimbursement from a Greensburg company.

Travelers Casualty and Surety Co. of America filed a complaint on Sept. 20 in the U.S. District Court for the Western District of Pennsylvania against Pellman Electric Inc., Darren C. Pellman and Lori D. Pellman alleging breach of contract.

According to the complaint, Pellman Electric Inc. entered into a subcontract to serve as an electrical subcontractor on a Pittsburgh construction project in 2014. The suit states the defendants executed a general agreement of indemnity in favor of the plaintiff, and the plaintiff named Pellman Electric Inc. as principal.

The suit states the plaintiff had to pay $244,502 to a third-party on the project that alleged it failed to receive payment for materials and equipment.

The plaintiff holds Pellman Electric Inc., Darren C. Pellman and Lori D. Pellman responsible because the defendants allegedly failed to reimburse the plaintiff for any amount in default of the agreement.

The plaintiff seeks damages and losses, all expenses incurred, future expenses and legal fees, interest and any further relief the court grants. They are represented by W. Alan Torrance Jr. of Dickie, McCamey & Chilcote PC in Pittsburgh.
