Man alleges Seneca Resources, National Fuel Gas Co. owe unpaid overtime wages

PITTSBURGH – A man formerly employed as a solid waste technician alleges that he was not paid overtime wages during his employment.

Gary McLaughlin filed a complaint on behalf of all others similarly situated on Sept. 19 in the U.S. District Court for the Western District of Pennsylvania against Seneca Resources and National Fuel Gas Co. citing the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiff was employed by the defendants as a solids control technician from May 2015 to November 2016 and was misclassified as an independent contractor.

The plaintiff holds Seneca Resources and National Fuel Gas Co. responsible because the defendants allegedly failed to pay overtime wages to the plaintiff for hours worked that exceeded 40 hours per week.

The plaintiff requests a trial by jury and seeks unpaid back wages, liquidated damages, interest, court costs and any further relief this court grants. He is represented by Joshua P.
