Labor secretary alleges Heart II Heart LLC failed to pay employees overtime

PITTSBURGH – A Pittsburgh company is alleged to have failed to pay employees for all hours worked.

Secretary of Labor for the United States Department of Labor R. Alexander Acosta filed a complaint on Sept. 25 in the U.S. District Court for the Western District of Pennsylvania against the Heart II Heart LLC and Toni Chandler Duncan citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that the defendants failed to pay overtime wages to their employees at the rate of one-and-one-half their regular rate of pay for hours worked that exceeds 40 per week. The plaintiff also alleges that the defendants required employees to attend mandatory orientation and failed to pay them for this time.

The plaintiff seeks to enjoin the defendants, unpaid minimum and overtime wages, liquidated damages, back wages, injunction, interest, court costs and any further relief the court grants. The plaintiff is represented by Nicholas C. Geale, Oscar L. Hampton III, Adam F. Welsh, Bertha M. Astorga and John A. Nocito of Office of the Solicitor, Region III in Philadelphia.
