PHILADELPHIA – A New Jersey man claims that a West Chester business terminated him because of the results of his background check.
Derek Marshall filed a complaint on behalf of himself and all others similarly situated on Oct. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Communications Test Design Inc. alleging violation of the Fair Credit Reporting Act.
According to the complaint, the plaintiff applied for a position with CTDI in West Chester in May and was hired to work in New Jersey. The suit states he was later terminated from employment following the results of his background check.
The plaintiff holds Communications Test Design Inc. responsible because the defendant allegedly discharged the plaintiff from employment without providing him a copy of his consumer report and a summary of his FCRA rights before his termination.
The plaintiff requests a trial by jury and seeks damages, statutory damages, treble damages, injunctive and equitable relief, court costs, interest, other injunctive and/or declaratory relief and any further relief the court grants.
