Man alleges Life Insurance Co. of North America wrongfully denied disability benefits

PHILADELPHIA – An individual alleges that his disability benefits claim was wrongfully denied.

Vijay Murugesh Adaikkappan filed a complaint on Sept. 29 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled due to several medical conditions, including chronic left iliac vein stenosis, chronic venous insufficiency and other disabling conditions. He alleges he was approved for long-term disability benefits in May 2016 by the defendant, but the defendant denied the claim the following September.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to conduct an independent medical examination before denying the claim.

The plaintiff seeks the amount of $4,400, court costs and any further relief the court grants. He is represented by Daniel M. McLean of Daniel M. McLean, Esquire in Swarthmore.
