URS/AECOM employee alleges that I.A.M. union failed to properly represent her

SCRANTON – A Stroudsburg woman alleges she was not adequately represented by her labor union in matters with her employer.

Sandra Clowney filed a complaint on Sept. 28 in the U.S. District Court for the Middle District of Pennsylvania against URS/AECOM, URS Federal Services, and I.A.M. International Association of  Machinists & Aerospace Workers, District 1 and Local 1717 citing the Labor-Management Relations Act.

According to the complaint, the plaintiff is an employee of URS/AECOM and worked at the Tobyhanna Army Depot. The plaintiff alleges that the defendant union failed to fairly and properly represent her on numerous occasions, including failing to protect and restore her economic losses and seniority when other union members were compensated after layoffs.

The plaintiff requests a trial by jury and seeks judgment against the defendant for breach of the collective bargaining agreement, all available relief, reinstatement, monetary damages, lost wages, fringe benefits, front pay, compensatory and punitive damages, consequential damages, court costs and any further relief the court grants. She is represented by Neil F. MacDonald of Durkin MacDonald LLC in Dunmore and Gerard H. Martillotti of Jerry Martillotti & Associates in Philadelphia.
