Man's lawsuit says Wawa and property maintenance company responsible for his shoulder injuries

PHILADELPHIA – A Croydon man believes combined negligence on the part of Wawa and its on-premises maintenance company led to an accident which led to serious injuries to his right rotator cuff and shoulder.

Arnold Barlow of Croydon filed suit in the Philadelphia County Court of Common Pleas on Sept. 29 versus Wawa, Inc. of Chester Heights and K&S Greenday Services, Inc. of Langhorne.

Wawa operates a store on Green Lane in Bristol and co-defendant K&S was obligated to provide snow and ice/removal salting services for the above-described real estate premises and parking lot, the suit says. Therefore, on Jan. 26, 2016, the plaintiff was caused to be injured by black ice through collective negligence of the defendants and permitting a dangerous condition to exist on the premises, according to the lawsuit.

Among his injuries, Barlow sustained a traumatic rotator cuff tear, supraspinatus tear of right shoulder and subscapularis tears, with related pain, suffering, permanent damage and difficulties with right shoulder movement and function, he claims.

For one count of negligence, the plaintiff is seeking damages in excess of $50,000.

The plaintiff is represented by Christopher T. Moyer of Master Weinstein Moyer, in Philadelphia.
