Worker claims Bell-Mark Technologies didn't pay overtime wages

SCRANTON — A Red Line man is suing an employer, citing alleged unpaid wages and violation of applicable minimum wage law, state law and workers' compensation acts.

Earl Haley filed a complaint Oct. 2 in the U.S. District Court for the Middle District of Pennsylvania against Bell-Mark Technologies Corp., alleging the employer failed to properly compensate the plaintiff for his work.

According to the complaint, the plaintiff alleges that he was a field services technician and worked more than 40 hours per week but was not paid any overtime wages. The plaintiff holds Bell-Mark Technologies responsible because the defendant allegedly failed to pay overtime wages to the plaintiff at the rate of 1.5 times the regular rate of pay for hours worked over 40 per week.

The plaintiff requests a trial by jury and seeks to prohibit the defendant from continuing its illegal practice, compensation for all wages owed including overtime, all pay and benefits due to the plaintiff, benefits illegally withheld, court costs, damages and any further relief this court grants.
