Woman claims Burger King fired her for seeking medical care

PITTSBURGH — A Bethel Park woman is suing an employer, citing alleged discrimination, retaliation, violation of the Family and Medical Leave Act and workers' compensation acts and wrongful termination.

Lisa Presto filed a complaint Oct. 2 in the U.S. District Court for the Western District of Pennsylvania against Tom King Penn LLC, doing business as Burger King, alleging it retaliated against the plaintiff for making complaints about being harassed by a previous supervisor.

According to the complaint, the plaintiff alleges that in 2016, she was terminated from her employment as retaliation for seeking medical attention for her condition. The plaintiff holds the defendant responsible because it allegedly terminated the plaintiff's employment after she went to the hospital to have a medical condition checked and informed her that "they did not want to deal with it."

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount sufficient to make her whole for all damages, back pay and benefits, front pay, compensatory damages, punitive damages, vacation pay, COBRA payments, bonus pay, liquidated damages, court costs and any further relief this court grants. She is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
