Woman seeks reinstatement of disability benefits from Lincoln National Life

PHILADELPHIA – A former administrative assistant alleges her disability benefits were wrongfully terminated and is seeking reinstatement to the plan.

Theresa Delaney filed a complaint on Oct. 19 in the U.S. District Court for the Eastern District of Pennsylvania against The Lincoln National Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff applied for short-term disability benefits from the defendant in April 2016, which were approved and then later denied on Aug. 31, 2016.

The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly failed to provide a full and fair review of her claim.

The plaintiff seeks payment of disability benefits, reinstatement to the plan, court costs, interest and any further relief the court grants. She is represented by Marc H. Snyder and Kellyanne Inservo of Rosen, Moss, Snyder & Bleefeld LLP in Jenkintown.
