Medtix LLC alleged to have defaulted on loans

PHILADELPHIA – A Malvern company alleges that a Delaware company failed to pay loans in full.

BB&T Commercial Equipment Capital Corp., formerly known as Susquehanna Commercial Finance Inc., filed a complaint on Oct. 31 in the U.S. District Court for the Eastern District of Pennsylvania against Medtix LLC alleging breach of contract.

According to the complaint, the defendant entered into commercial or equipment finance agreements with the plaintiff in December 2015, February 2016, June 2016 to purchase equipment.

The plaintiff holds Medtix LLC responsible because the defendant allegedly failed to make monthly payments when due plus late fees.

The plaintiff seeks judgment against the defendant, declare plaintiff's right to possession of the equipment, damages in the amount of $165,617.11, plus expenses of collection including attorney's fees at the rate of 15 percent of the balance plus interest, late charges, interest, court costs and any further relief the court grants. It is represented by Barbara L. Farley and of Barbara Lanza Farley in Philadelphia.
