Consumer claims FBCS Inc. debt collection letter is unlawful, misleading

PHILADELPHIA – A Tennessee consumer alleges that a Hatboro debt collector mailed her a misleading collection letter.

Courtney Smith filed a complaint on Nov. 1 in the U.S. District Court for the Eastern District of Pennsylvania against FBCS Inc. alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Nov. 4, 2016, she received a collection letter from the defendant regarding her alleged debt. She alleges the letter states the amount balance is "$493.60 (may include interest and fees)" but does not say if the interest will continue to accrue until the alleged debt is settled. 

The plaintiff holds FBCS Inc. responsible because the defendant's letter allegedly is deceptive and misleading because it does not set forth the principal balance and what portion is collection fees or interest.

The plaintiff seeks actual damages, statutory damages, court costs, declaratory relief and any further relief the court grants. She is represented by Antranig Garibian of Garibian Law Offices PC in Philadelphia.
